Terms of Service
These terms govern your use of the 2Brother website, the 2Brother CRM mobile app and web console, and any AI, Meta, WhatsApp or telephony service we deliver to you. Using any of them means you accept these terms.

1. Who these terms are between
They are between you and 2Brother AI LLP, a limited liability partnership registered in India with its office at Yeshwanthpur, Bengaluru, Karnataka 560022.
If you are using our software because your employer deployed it, then your employer's agreement with us governs the service, and these terms govern your own use of it as a user.
2. What we provide
- Software. The 2Brother CRM mobile app and web console, licensed to your organisation for the term of its subscription or engagement.
- Development services. AI agents, AI-driven projects, Meta and WhatsApp integrations, mobile and web applications, MDM setup and IT engineering — each delivered under a written scope of work that sets out the deliverables, timeline and price.
- Operations. Where agreed, hosting, monitoring and support for what we built.
Where a signed scope of work or master services agreement conflicts with these terms, that document wins.
3. Acceptable use
You must not use our services to:
- Break any law — including India's telecom regulations, TRAI's rules on unsolicited commercial communication, the DPDP Act, and the laws on call recording consent in the jurisdiction you are calling into.
- Send spam, or message anyone who has not opted in or has asked you to stop. If you use WhatsApp through us, Meta's own policies bind you directly.
- Upload leads or contact data you have no lawful basis to hold.
- Record a call where the law requires the other party's consent and you have not obtained it. This is your responsibility, not ours.
- Reverse-engineer, resell or sublicense our software, or attempt to defeat its access controls or tenancy isolation.
- Probe, load-test or attack our infrastructure without our written permission.
We may suspend an account immediately, without refund, if it is being used in a way that breaks the law or endangers other customers. We will tell you why.

5. Your data
Your data stays yours. We process it only to run the service for you and only on your instructions, as set out in the Privacy Policy. We do not use your data or your customers' data to train models for anyone else, and we do not sell it.
You can export your data at any time. If you leave, we return or delete your entire dataset within 90 days — see Data Deletion Instructions.
6. Intellectual property
- What we build for you under a scope of work becomes yours on full payment — source code, infrastructure definitions and documentation.
- Our own platform and pre-existing tooling — the 2Brother CRM product, our agent framework, our internal libraries — remain ours, and you get a licence to use them for as long as your engagement runs.
- Your content and trademarks remain yours. We will only refer to you publicly as a client if you say we may.
7. AI output
AI agents are probabilistic. They can be wrong. We build evaluation, guardrails and human checkpoints into anything consequential, and we tell you where the residual risk sits — but you must not rely on AI output as the sole basis for a legal, financial, medical or safety decision without a human reviewing it. Where our agents act on your systems, you control what tools they are given and which actions require sign-off.
8. Third-party platforms
Parts of the service depend on Meta, Google, telecom operators and cloud providers. Their terms apply to you as well as to us, and their platforms change. If Meta changes a policy or an API and that breaks a feature, we will tell you promptly and work with you on the fix — but we cannot be liable for a third party's decision.
9. Fees
Fees, milestones and payment terms are set in your scope of work. Invoices are payable within the period stated on them. Overdue amounts may attract interest at the rate stated in the scope of work, and we may pause work on an account that is materially overdue after giving written notice.
10. Warranties, and their limits
We warrant that we will perform our services with reasonable skill and care, and that anything we deliver will materially conform to its agreed scope. We will fix defects reported within the warranty period stated in the scope of work at no charge.
Beyond that, the services are provided “as is”. We do not warrant that they will be uninterrupted or error-free, nor that any specific commercial result — a conversion rate, a connection rate, an approval — will follow.
11. Limitation of liability
To the maximum extent the law allows, neither party is liable for indirect, incidental or consequential loss, or for loss of profit, revenue, goodwill or data. Our total aggregate liability for any and all claims is capped at the fees you paid us in the twelve months before the claim arose.
Nothing here excludes liability for fraud, wilful misconduct, death or personal injury, or anything else that cannot lawfully be excluded.
12. Indemnity
You indemnify us against claims arising from your unlawful use of the service — in particular claims brought by people you called, recorded or messaged without a lawful basis, and claims arising from data you uploaded that you had no right to hold.
13. Termination
Either party may terminate an engagement as set out in the scope of work, or immediately if the other materially breaches these terms and does not fix it within 30 days of written notice. On termination, you pay for work delivered up to that point, and we return or delete your data as described in section 5.
14. Governing law
These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction, save that either party may seek urgent injunctive relief anywhere.
15. Changes
We may update these terms. Material changes are notified by email or in-app at least 30 days before they take effect, and the “Last updated” date at the top always reflects the current version. Continuing to use the service after that date means you accept the change.
